Schedule 3 agreements
The Water Services etc (Scotland) Act 2005 permitted certain pre-existing agreements between Scottish Water and customers, where the charges are not in the Scottish Water Wholesale Charges Scheme.
These special agreements were discussed in Schedule 3 of the act and, as a result, have become known as Schedule 3 agreements.
In November 2006, the retail elements of the Schedule 3 agreements were transferred to Business Stream and we've drafted a short summary.
The Schedule 3 agreements are legal contracts and mostly contain confidential obligations for both Business Stream and the customer. These agreements cannot be extended and Business Stream cannot enter into a similar agreement with any other customer. The details published here are for information only.
The Water Services etc (Scotland) Act 2005, under section 29e, does allow for a different kind of agreement to be created. This is where the Water Industry Commission for Scotland consents to a departure from Scottish Water's wholesale charges scheme in certain situations.
